Terms and Conditions

These are the terms and conditions for Cimple Cleaning Limited for the use of our service (“T&Cs”). These T&Cs apply to the use of this website, and by using the website and/or making a Booking for the use of our service, you agree to the T&Cs set out below. If you don’t agree to the T&Cs, then it’s advised not to use the website and/or service.

1) DEFINITIONS

"Booking" means a booking for our services made by You on our website

"Services" means our home cleaning services or other cleaning services we offer;

"Cleaner" means a cleaner or other cleaning service provider commissioned through the use of our Services/Website;

"We/Us" means Cimple Cleaning Limited, of Cimple Cleaning, 124 City Road, London, EC1V 2NX, with Company Registration Number 15733775;

"Website" means the website accessible at www.cimplecleaning.co.uk and any other pages with this domain, or any domain we may migrate to;

 "You/User" means a user of this Website.

2) USE OF THE WEBSITE

 

2.1 Access

You are accessing this Website in agreement with the T&Cs, and any Booking(s) by You or someone on your behalf must be compliant with these T&Cs.

 

2.2 Registration

2.2.1 By signing up as a User of our Website and Service, You are permitting that;

 

(a) The personal information that You are providing when you sign up as a User and/or make a Booking is true, up-to-date and complete, and

 

(b) You will let us know immediately of any changes to your personal information by emailing us at hello@cimplecleaning.co.uk

 

2.2.2 You agree not to impersonate another person or entity or falsely use a name or an individual You do not have consent to use.

2.3 Our rights

We reserve the right to:

(a) change or remove, temporarily or permanently, this Website (or any part of) with or without communication to you, and you confirm that we are not liable to you or any third party for any changes or removal of the Website and/or

(b) occasional changes to these T&Cs as explained below. If you don’t agree with the changes to the T&Cs, you must stop using the Website and Services. If you do continue to use the Website and Services, you will be seen as accepting the T&Cs changes.

 

3) THE CIMPLE CLEANING PLATFORM

 

3.1 We operate as a booking agency for self-employed Cleaners. Our contract with You is only for the provision of the Website.

3.2 Your Cleaner is responsible for delivering the Services to you. You and your Cleaner have a direct contract regarding the Services provided. The contract between You and your Cleaner doesn't involve Us, and You and your Cleaner will be responsible for any taxes and/or damages that occur from the Services.

3.3 We review all applications, interview all candidates and carry out checks on all Cleaners, with some information dependent on third parties during this process. By using our Website and Services, You acknowledge that we can't guarantee 100% accuracy or completeness of the information during our process, whether carried out by us or third parties.

3.4 You agree that you will use Cleaners at your own risk. You also agree to provide a safe working environment for all Cleaners and will take the necessary actions to be in charge of the Cleaners.

3.5 If a dispute happens in relation to the Services, we might agree or offer to act as a mediator for You and the Cleaner in an attempt to resolve the issue(s). If You want Us to mediate on your behalf, you must quickly let us know the issue/dispute and provide Us with any additional information that will help when requested. We can't guarantee a successful or satisfying mediation, and you will still be responsible for resolving the dispute between You and the Cleaner.

3.6 We will not, in any circumstance, be responsible for damages, including but not limited to: damages caused by corrosive cleaning products, including but not limited to bleach and/or oven cleaner, damages resulting from spillages, damages to items that need specialist care and/or cleaning products, damages to cleaning equipment and/or where instructions through the Website was not given, damages to Your property and/or cleaning equipment before the clean, and damages that couldn't be foreseen or prevented by Us as provider of the Website.

4) BOOKING SERVICES

 

4.1. Booking through our Website, you agree that you are at least 18 years old and legally capable of entering into a binding contract.

4.2 All bookings are subject to acceptance by Us, and We will confirm that We have accepted the Booking by sending You an email. The agreement/contract between Us and You and between You and the Cleaner will only be established when You receive the Booking confirmation email.

4.3 You agree that you won’t Book any Services from a Cleaner outside of our Website for the length of this agreement and 3 months after the termination of this agreement.

​4.4 A deposit will be required at the time of booking. You are required to pay a deposit equal to 30% of the total cost of the Services. The deposit is non-refundable except in the circumstances stated in these T&Cs. The remaining balance will be due on the day of or after the scheduled service.


4.4. Bundle Services


4.4.1. Bundles are offered at a discounted hourly rate, provided You commit to a minimum service period of three (3) bookings.


4.4.2. The maximum usage is limited to one booking per week, and the minimum usage is limited to one booking per month. The bundle service allows for one Booking per month to be rolled over to the following month.


4.4.3. Deposits for each bundle booking will be collected 72 to 48 hours prior to the scheduled service. Failed deposit transactions will jeopardise the confirmation of your booking.


4.4.4. Cancellation policies in Section 7 apply.


4.4.5. Bundles require a 30-day written notice to terminate.


4.4.6. At the end of the bundle period, the service will automatically renew, continuing the Bundle service at the same discounted rate unless cancelled with 30 days’ notice.


4.5. Regular Cleaning Services


4.5.1. Our regular cleaning service requires a minimum service period of six bookings.


4.5.2. The regular cleaning service requires a 30-day written notice to terminate.


4.5.3. Missed or failed payments will result in the immediate pause of all services until payment is made.


4.5.4. Customers of the regular cleaning service are entitled to receive discounts on additional services or add-ons as advertised.


4.5.5. We reserve the right to modify the service by adding and/or removing features at any time.


4.5.6. Annual price increase policy in Section 5.10 applies.


4.5.7. Billing occurs after each booking unless otherwise agreed.


4.4.2. The maximum usage is limited to one booking per week, and the minimum usage is limited to one booking per month. The bundle service allows for one Booking per month to be rolled over to the following month.


4.6. Subscription Services


4.6.1. Subscription customers will be billed automatically on the 1st day of each month for that month’s service.


4.6.2. Subscriptions are subject to a 14-day statutory cooling-off period beginning the day after sign-up, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.


4.6.3. Customers are entitled to two priority bookings each month within the subscription service.


4.6.4. The maximum usage is limited to two bookings per week, and the minimum usage is limited to one booking per month. The subscription service allows for one Booking per month to be rolled over to the following month.


4.6.5. If You cancel within the cooling-off period after services have commenced, You will be liable for payment for any services already delivered.


4.6.6. Annual price increase policy in Section 5.10 applies.


4.6.7. Missed or failed payments will result in the immediate pause of all services until payment is made.


4.6.8. Customers of the subscription service are entitled to receive discounts on additional services or add-ons as advertised.
 

5) PRICE AND PAYMENT

 

5.1 The price of the Services will be displayed on our Website, except in the circumstance of an obvious error.

5.2 Prices can change at our discretion at any time, but changes will not affect Bookings that are pending and/or have been confirmed by email.

5.3 Every attempt has been made through our web providers to ensure a Booking is safe and secure. We can't be responsible for fraudulent use on the Website due to loss/theft of a payment card.

5.4 You must keep an up-to-date and valid payment card with Us at all times. You are responsible to let Us know immediately if your payment card is out-of-date and/or invalid.

5.5 You give Us permission to do a pre-authorisation of your payment card. You also allow Us to charge your payment card in full on the day of the Booking, on the day of the scheduled Booking or after the scheduled Booking.

5.6 If the amount due by You is unpaid after the day of the scheduled Booking, You give Us the permission to be able to charge your payment card a £10 administration fee and interest each month the amount goes unpaid.

5.7 A promotional code, credit, gift card, voucher or discount will be used by new customers. Offers can only be redeemed for the following: once per household, once per customer, for our weekly or fortnightly home cleaning service, and a "first time" one-off cleaning for a maximum of 4 hours. 5.8 Cimple Cleaning has the choice to provide promotional offers to potential and existing customers to market Cimple Cleaning as an agent. Our promotional offers won't reduce the compensation received by the Cleaner. You, as the customer, agree that any promotional offers paid by the customer to the Cleaner will be at the standard rate paid to the Cleaner.

5.9 The total price of the Service is as quoted at booking. You must pay the 30% deposit at the time of booking. The remaining 70% shall be paid on the day of or after the service.


5.10 Service prices will increase annually in line with the Office for National Statistics Consumer Price Index (CPI), capped at 3.9% per annum. Increases will take effect on 1 April each year. Continued use of Services after this date constitutes acceptance of the adjusted price.
 

6) BOOKING CANCELLATION BY US

 

6.1 If you're found to violate any of the T&Cs and Code of Conduct, you agree that your permission of the Services and Website will be immediately terminated.

6.2 We have the right to cancel any Booking without cause and/or notifying you.

7) BOOKING CANCELLATION BY YOU

7.1 You can cancel or reschedule a Booking up to 24 hours before your scheduled Booking for free, and your deposit will be refunded.


7.2 If you cancel less than 24 hours before your scheduled Booking, or the Cleaner arrives and cannot gain entry into the property or start the cleaning, you will forfeit your deposit and may also be charged the full price of the Booking.


7.3 In cases of cancellation by You less than 24 hours before the Booking, no refund of the remaining balance (if already paid) will be given.


7.4. For Bundles and Regular Cleans, cancellation of the entire contract requires 30 days’ written notice. Subscription services may be cancelled in writing at any time after the initial 14-day cooling-off period, with cancellation taking effect from the next billing cycle.

8) INSURANCE

 

8.1 We have a £1 million public liability insurance policy with an established insurer. There are excesses of at least £500, depending on the claim, which will be a cost to you.

8.2 This policy will only be available to cover extreme circumstances, for example, a serious injury to the Cleaner.

9) THIRD-PARTY LINKS

 

Links to third-party websites on the Website are only for convenience, and clicking on these links will result in you leaving the Website. We are not obligated to review and don't have control over these third-party websites. So we don't endorse and are not a representative for them, and vice versa, unless explicitly stated on the Website. If you choose to access any third-party links from the Website, you will do this at your own risk.

10) PRIVACY

 

We process your information in accordance with our Privacy Policy. By using our Website, you agree to how we process and always provide Us with valid and up-to-date data.

11) LIABILITY

 

11.1 Our liability for losses you incur as a result of Us breaking our T&Cs is strictly limited to the cost of the Services You purchased in the last six months.

11.2 Our liability for losses doesn’t include or is limited to our liability for death or personal injury caused by negligence, fraud or any other matter which is illegal for Us to exclude our liability.

11.3 We are not responsible for any indirect losses that may happen as a result of the main loss or damage, including but not limited to: loss of monetary gain, loss of income or revenue or profit, loss of business, loss of potential savings, loss of data, and loss of time.

11.4 We will take all reasonable care, based on our ability, to keep the details of your Booking and payment secure and safe. But in the situation of negligence on our part, we can’t be liable for any losses you may have as a result of a third-party system accessing any data from our Website unauthorised.

12) EVENTS OUTSIDE OUR CONTROL

 

12.1 We won’t be liable or responsible for any failure to deliver our Services or late delivery of our Services, in any of our contractual obligations caused by events outside our reasonable control (“Force Majeure Event”).

12.2 Force Majeure Event includes but is not limited to: events or incidents beyond our reasonable control and including but not limited to: strikes, lockouts or industrial action, riots, invasions, potential or actual terrorist attacks, war, fire, explosion, natural disasters, epidemic, impossible use of transport, impossible use of telecommunications or government restrictions.

12.3 Our ability to deliver Services under any contract is to be suspended while the Force Majeure Event is happening, and we’ll have an extension of time to deliver our Services during this period. We will use reasonable measures to find a solution by which we deliver and complete the Services despite the Force Majeure Event.

13) CLIENT RESPONSIBILITIES REGARDING VALUABLES

 

13.1 Securing Valuables:

 

Clients are required to secure or remove all valuables, including but not limited to cash, jewellery, electronics, and personal documents, prior to the commencement of any cleaning services. Cimple Cleaning and its contracted cleaners will not be held responsible for any loss or damage to unsecured items left in plain sight or in accessible areas during the cleaning process.

 

13.2 Liability for Unsecured Items:

 

By agreeing to these Terms and Conditions, clients acknowledge that Cimple Cleaning disclaims any liability for the loss of or damage to valuables that are not properly secured or stored away before the provision of cleaning services.

14) GENERAL

 

14.1 Intellectual property and right to use

 

14.1.1 The copyright and other intellectual property rights on the Website are owned by Us. Any access or use of the Website outside of personal and/or non-commercial use is not allowed.

14.1.2 Any of the content on our Website can’t be reproduced or stored on any other website or included in any public or private retrieval systems without our prior written approval.

14.1.3 You agree that the content and agreements on the Website are available for personal, non-commercial use only. You can download the material onto one computer for personal, non-commercial purposes, and any use outside of this is not allowed.

14.1.4 You agree not to and/or facilitate the copying, reproduction, publishing, displaying, distribution, taking advantage of, or creating imitative work from our material.

14.1.5 Content on our Website, such as reviews, comments and ratings, you agree for Us to have a global, perpetuity, non-exclusive, royalty-free licence to display and change this content on the Website.

14.2 Compliance with laws

 

The Website must be used for a lawful purpose and manner. You are obliged to comply with all laws, statutes and regulations regarding the Website and Bookings completed through the Website.

14.3 Written Communications

 

By law, We are obligated to provide some information or communication, such as posting or notices, to You in writing. By using the Website, you agree that communication will be sent digitally. Information We send to you digitally will comply with any legal requirement that this be communicated in writing. However, this does not affect your statutory rights.

14.4 Notices

 

Notices you send Us must be sent to Cimple Cleaning, 124 City Road, London, EC1V 2NX. We may give You notice by email, SMS or postal mail with the information You have provided from completing a Booking. We will determine a notice to be received and served when posted on the Website, 24 hours after the email was sent and three to five days after the letter was posted.

14.5 Transfer of rights and obligations

 

14.5.1 The contract between You and Us is binding on You and Us.

14.5.2 You can’t transfer, assign, charge or sell a contract, or any of your contractual obligations, without written consent from Us.

14.5.3 We may transfer, assign, charge, sub-contract or sell a contract, or any of our contract obligations, at any time during the length of the contract.

14.6 Severance

 

If at any time parts of the T&Cs become unlawful, void or unenforceable, then that specific clause is to be severable from the T&Cs and won’t impact the validity of the remaining clauses of these T&Cs.

14.7 Waiver

 

No waiver by Us will be interpreted as a waiver of any proceeding or succeeding breach of any clauses.

14.8 Entire Agreement

 

These T&Cs and any other documents mentioned in them will be part of the agreement between Us and any matter of any contract and supersede any previous communications or agreements between Us.

14.9 Our Right to Vary These T&Cs

 

We have the right to change and amend these T&Cs at any time. You will be subject to the policies and T&Cs at the time You are accessing the Website and/or Booking the Services. We advise you to regularly check the Website for updated versions.

14.10 Single Address Restriction:


Services purchased may only be applied to a single property address. If You move property within our service area, You may continue the contract. If You move outside of our service area, You may cancel the contract by providing 30 days’ written notice.

14.11 Law

 

These T&Cs and contracts are governed by and in accordance with the laws of England, and You are to permanently submit to the jurisdiction of the courts of England. Any disputes or claims that arise regarding the contract or the formation, including non-contractual disputes or claims, will be subject to the jurisdiction of the courts of England and Wales.
